Welcome to FitnessCan! These Terms of Service ("Terms") govern your access to and use of the FitnessCan mobile application and related services ("Service"), which is owned and operated by JennJ Health LLC ("Company," "we," "our"). By accessing or using FitnessCan, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Service.

2. User Accounts & Responsibilities

You must be at least 18 years old to use the Service. If under 18, you must have parental or guardian consent.
You are responsible for maintaining the confidentiality of your account credentials and all activity occurring under your account.
You agree to provide accurate and complete information when creating an account.

3. Health Disclaimer

FitnessCan does not provide medical advice, diagnosis, or treatment. The Service is intended for informational and fitness tracking purposes only.

Use of the Service is at your own risk, and FitnessCan is not responsible for any health-related decisions you make based on the information provided.

4. Data Collection & Privacy

We collect and process user data in accordance with our Privacy Policy.
If you choose to link FitnessCan with third-party services or wearable devices, you grant us permission to access and process your fitness data.
FitnessCan takes reasonable security measures to protect user data but cannot guarantee absolute security.

5. AI-Generated Insights Disclaimer

 FitnessCan may use artificial intelligence to analyze fitness and health data and provide insights.
These insights are informational only and should not be considered medical advice.
AI predictions or recommendations do not replace professional medical evaluation.

6. Acceptable Use Policy
You agree not to:

Use the Service for any unlawful or unauthorized purposes.
Attempt to reverse-engineer, modify, or distribute any part of the Service.
Use automated systems (bots, scrapers) to access the Service without permission.

7. Subscriptions & Payments

Certain features may require a subscription or in-app purchases.
All payments are non-refundable unless otherwise stated in our refund policy.
Subscriptions will auto-renew unless canceled before the renewal date.

FitnessCan is provided "as is" and "as available" without warranties of any kind.
We are not liable for any direct, indirect, incidental, or consequential damages resulting from your use of the Service.
Our total liability in any case shall not exceed the amount you paid for the Service in the last six months.

These Terms are governed by the laws of the State of California, without regard to its conflict of law principles. Any disputes shall be resolved exclusively in the courts of California.

We may update these Terms periodically. Continued use of the Service after changes constitutes acceptance of the revised Terms.
